The 28-year fight over who owns Linux is nearly over
The U.S. Court of Appeals for the Second Circuit affirmed a district-court judgment that Xinuos’s remaining copyright claim against IBM is time-barred, ruling the infringement occurred in 2001 and the three-year limitation expired even if Xinuos learned of it in 2011. The court clarified that the dispute concerns IBM’s license to use the code, not ownership, and affirmed dismissal of Xinuos’s arguments as without merit.
