EU employment law 2026 moved the burden of proof to you

In 2026 three EU employment laws shifted proof burdens to employers: the Pay Transparency Directive mandates pay-range disclosure and gender-pay data requests, yet only four states complied by the June 7 deadline; the AI Act imposes transparency fines up to €15 million or 3% of global turnover from August 2; and the Dutch Civil Code amendment presumes employment for work paid under €38 per hour, requiring companies to demonstrate the absence of an employment relationship.
