Kalshi loses again as judges rule prediction markets must obey gambling laws

The Sixth Circuit Court of Appeals ruled that Kalshi’s sports-event contracts do not meet the statutory definition of a “swap,” so the Commodity Futures Trading Commission’s exclusive jurisdiction does not apply. Even if the contracts were swaps, the court held that the Commodity Exchange Act does not preempt Ohio’s or Tennessee’s gambling laws, allowing state enforcement.
