Microsoft tells court Copilot rarely copies books while selling OpenAI’s most capable model

Microsoft told a Manhattan federal court that Copilot matched book passages only 24 times in 8.2 million conversations (0.00029%) and found no matches for 202 of the 212 cited books. Two days later it released GPT-6 Astra in the Foundry Limited Access Program at $10 per million input tokens, a model OpenAI classifies as “Critical” for cybersecurity, capable of reading on-screen data, updating records, testing software and navigating development tools. European courts and the AI Act assess model parameters and systemic risk rather than copied-output frequency.
