"Tweet" and the bird logo apparently enter the public domain
The court held that X’s Apple App Store listing, which includes “formerly known as Twitter,” demonstrates bona-fide use of the TWITTER mark, preventing its abandonment. The TWEET trademark and bird logo were found likely abandoned because they do not appear on X’s app listing or x.com homepage and X showed no intent to resume use. The order is a preliminary injunction, not a final merits decision, effectively returning the TWEET term and bird logo to the public domain.
